Provisional Partner Visa – Subclass 820

In this subclass visa you submit onshore application while you are  in Australia on the basis of your married or de facto relationship with your partner on a temporary visa

Your partner must provide sponsorship for you and they must be one of the following:

  • an Australian citizen
  • an Australian permanent resident
  • an eligible New Zealand citizen
  • The visa allows you to:

remain in Australia with your partner, until a decision is made regarding your permanent visa and while the application is being processed, you may be allowed to

  •   work in Australia (case by case based)
  •  study in Australia, but you will not have access to government funding for tertiary study and will be charged international upfront full fees
  •  enrol in Australia’s medical benefits expenses and hospital care scheme, Medicare

Provisional Partner Visa –  Subclass 309

  • This visa will allows you to enter Australia on the basis of your married or de facto relationship with your partner and the application is to be submitted while you are offshore.

Your partner must provide sponsorship for you and they must be one of the following:

  • an Australian Citizen
  • an Australian Permanent Resident who either settled in Australia or have strong ties to Australia
  • an eligible New Zealand citizen who either settled in Australia or have strong ties to Australia
 
When the visa is approved, you may enter Australia as the holder of 309 visa with the the following rights:
  • full  work rights in Australia 
  •  study in Australia, but you will not have access to government funding for tertiary study and will be charged international upfront full fees
  •  enrol in Australia’s medical benefits expenses and hospital care scheme, Medicare
